1. Acceptance of Terms

By installing, accessing, or using the TextBlasts.app Chrome extension (via the Blasts extension), the website (textblasts.app), or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by Tips Marketing Services, Corp ("we," "us," or "our"), a New Jersey corporation.

2. Description of Service

TextBlasts.app provides tools to compose, pace, and audit bulk text-message campaigns sent through your own messaging provider accounts. Key modules include:

Bring-Your-Own Provider. Send via your own Twilio or Telnyx account (more providers over time). By default your API keys stay encrypted on your device and nothing routes through us; if you opt into cloud sync to send from the online portal, see the "Optional Online Portal & Cloud Sync" section below.
Multi-Channel Routing. Round-robin, priority, or cost-optimized distribution across your enabled sending numbers, with per-number daily caps and automatic failover.
List Hygiene. E.164 normalization, de-duplication, and Line Type Check to drop landlines that cannot receive texts.
Opt-Out Management. Automatic STOP handling and a do-not-text suppression list honored on every send.
Rich Messaging (rolling out). MMS media and RCS branded, verified-sender messaging with automatic fallback to SMS on devices that don't support it.

3. You Are the Sender of Record — Consent & Compliance

Because every message is sent from your own provider account and your own phone number, you are the sender of record and are solely responsible for the legality of your campaigns. You represent and warrant that:

You have obtained prior express consent from every recipient before texting them, as required by the Telephone Consumer Protection Act (TCPA) and applicable state law.
You will comply with the CTIA Messaging Principles & Best Practices, carrier A2P 10DLC registration requirements (and, for RCS, Google/carrier brand registration), and your provider's Acceptable Use and messaging policies.
You will clearly identify yourself and include opt-out instructions (e.g., "Reply STOP to opt out") in your messages, and you will honor every opt-out promptly.
You will not text emergency lines, reassigned/wrong numbers you know to be such, or recipients during prohibited hours under applicable quiet-hours rules.

TextBlasts.app provides opt-out tooling (STOP keyword handling, a do-not-text list, and line-type filtering) as a convenience, but using these tools does not transfer compliance responsibility to us. Consent and record-keeping remain yours.

4. Permitted Use

You agree to use the Service only for lawful purposes. You shall not:

Send unsolicited texts (spam), or messages to recipients who have not consented or who have opted out.
Send content prohibited by carriers or the CTIA (the "SHAFT" categories — sex, hate, alcohol, firearms, tobacco — where restricted, plus illegal or high-risk financial content).
Harvest or purchase phone lists without valid consent, or evade carrier filtering, 10DLC registration, or rate limits.
Transmit malicious links, phishing, or defamatory content.
Tamper with, decompile, or bypass licensing control or credit metering.

5. Credits & Payments

Service-Fee Model. Bulk texting consumes credits from your prepaid credit pool as a service fee, metered only on messages actually sent. The fee is a per-unit credit coefficient set by your purchase tier: SMS is billed per 160-character segment (Starter 0.6 · Pro 1 · Gorilla 16 credits per segment) and MMS and RCS are billed per message (Starter 1.8 · Pro 3 · Gorilla 50 credits per message) — approximately $0.80–$1.50 per 1,000 SMS segments and $2.50–$4.50 per 1,000 rich messages depending on tier. This is separate from your provider's own per-message charges, which your Twilio/Telnyx account pays directly. Credits never expire and are shared with your other Blasts services.

Non-Refundable. Consumed credits are non-refundable. If a campaign runs out of credits it pauses automatically until you top up, so there are no partial or failed batches.

6. Third-Party Providers

The Service connects to messaging providers you choose, including Twilio and Telnyx (and rich-messaging/RCS providers as available). Your use of those providers is governed by their own terms, and they bill your account directly for message delivery. We are not responsible for their availability, pricing, deliverability, or account actions (including number suspensions).

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. In no event shall Tips Marketing Services, Corp be liable for any indirect, incidental, or consequential damages (including, without limitation, carrier filtering or blocking, number suspension by your provider or a carrier, TCPA/CTIA claims arising from your campaigns, or lost revenue) arising from your use of the Service.

8. Governing Law

These Terms are governed by the laws of the State of New Jersey. Any dispute arising out of these Terms shall be resolved exclusively in the state or federal courts of New Jersey.

9. Optional Online Portal & Cloud Sync

By default the Service runs on your device and your credentials never leave it. As an opt-in convenience, you may enable "Sync sending accounts to secure cloud for mobile portal access" in the extension so you can compose and send Text Blasts from the online portal (blasts.app/portal) on a phone or tablet. When enabled, your texting provider API keys and selected sending numbers (and any recipient lists you choose to push) are transmitted over TLS and stored re-encrypted at rest using AES-256-GCM, decrypted only in memory during an active send, and used solely to send your own campaigns. You remain the sender of record and responsible for consent and compliance. This sync is off by default and you may erase the cloud copy at any time by turning the toggle off.
